Information on personal data protection

Acting pursuant to Article 13 Section 1 and 2 of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (EU Official Journal L 2016.119.1) - hereinafter referred to as GDPR,

Answers to inquiries with regard to personal data will be given without undue delay, but no later than within one month.

3. Your personal data is processed in accordance with the following legal basis:

  1. For the purpose of processing contracts for commercial and marketing cooperation (Article 6 Section 1 (b) of GDPR)
    Providing personal data is voluntary, but failure to do so may prevent the performance of the contract.

  2. In order to fulfil the legal obligation (Article 6 Section 1 (c) of GDPR)

  3. For the purpose of recruitment (Article 6 Section 1 (a)(c) of GDPR)

  4. In order to exercise the Controller's legal interests (Article 6 Section 1 (f) of GDPR) in the scope of: providing services to customers, marketing, customer satisfaction surveys, handling complaints.

  5. As part of the CCTV monitoring system at ERG BIERUŃ Sp. z o.o., data is collected in the form of your image for the purpose of exercising legal interests of ERG BIERUŃ - FOLIE Sp. z o.o., the Controller, and in order to ensure the safety of employees, contractors and their representatives, and Customers (Article 6 Section 1 (f) of GDPR)

4. Personal data is processed manually and automatically without profiling.

5. Your data may be shared with entities cooperating with ERG BIERUŃ Sp. z o.o. and entities with whom we cooperate for the purposes of providing our services, including entities providing postal, courier, legal, banking, IT debt collection, transport services, and with institutions to which data sharing is of a statutory nature.

6. Your data will not be transferred to third countries or international organizations.

7. The Controller shall exercise best efforts to ensure that the personal data stored is protected by physical, technical and organizational measures against their accidental or intentional violation.

8. Personal data retention period:

  1. until the end of the contract term including the period of data storage arising from applicable provisions of law,

  2. for the term of exercising the Controller's legitimate interests,

  3. until the consent to the processing of personal data for marketing purposes is withdrawn,

  4. 12 months from the date of receiving personal data in the recruitment process,

  5. 1 month for CCTV records.

9. In connection with the processing of your personal data, you have the right to:

  1. access your personal data,

  2. rectify, erase or restrict data processing,

  3. object to data processing,

  4. transfer your personal data,

  5. file a complaint to the the President of the Personal Data Protection Office.

10. If your personal data is processed on the basis of consent provided, you have the right to withdraw it at any time. Withdrawals of consent in writing may be sent by post to ERG BIERUŃ – FOLIE Sp. z o.o. ul. Chemików 163, 43-150 Bieruń (with a note “personal data”) or by e-mail to: daneosobowe@ergbierun.pl
